Do I Qualify for DACA?

Important 2026 Updates

Due to ongoing court decisions, USCIS continues to process DACA renewals for current recipients, but new initial DACA applications are not being approved at this time. Renewals are still available, but processing times can now take 3 to 4 months or longer. File your renewal 4 to 5 months before your current DACA expires to avoid any gap in protection or work authorization. Always check uscis.gov for the latest status.

Who Qualifies for DACA?

To apply for DACA, you must meet these key criteria:

  1. Age Requirements: You must have been under 31 years old as of June 15, 2012, and arrived in the U.S. before your 16th birthday.
  2. Residency: You must have continuously lived in the U.S. since June 15, 2007, and been physically present on June 15, 2012.
  3. Education or Military Service: You need to be in school, have graduated, earned a GED, or been honorably discharged from the military.
  4. Criminal Record: You must not have been convicted of a felony, a significant misdemeanor, or three or more minor misdemeanors.

DACA does not provide permanent residency or citizenship, but it gives eligible individuals temporary protection and a chance to build their futures in the U.S.
