Let’s get right into the Consequences of a DUI Conviction in California:

License Suspension:
If you are convicted of a DUI in California, your driver’s license will be suspended. The length of the suspension will depend on a number of factors, including whether this is your first offense or if you refused to take a breathalyzer test. A first-time offender can face a license suspension of up to 4 months, while a second-time offender can face a suspension of up to 2 years. It is important to note that the DMV administrative action against your license is unique from the court case for the DUI charges. You may need representation for both.

Fines and Fees:
A DUI conviction in California can result in significant fines and fees. For a first offense, you can be fined up to $2,000. However, if you caused injury or death while driving under the influence, the fines can be much higher.

Jail Time:
In addition to fines and fees, a DUI conviction can also result in jail time. A first-time offender can face up to 6 months in jail, while a second-time offender can face up to 1 year. That said, 6 & 12 months are the maximum punishment under California law. In Monterey County, my clients often receive sentences of just 2-5 days of sheriff work alternative program for their first offense, absent egregious facts.

Increased Insurance Rates:
A DUI conviction can also result in increased insurance rates, as you will be considered a high-risk driver. This can result in significantly higher premiums and make it more difficult to obtain insurance coverage. With the SR-22 filing, the long term costs of insurance hikes will likely exceed the court fines and fees.

Potential Job Loss:
If you rely on your driver’s license for your job, a DUI conviction can result in the loss of your job. This is particularly true if you hold a commercial driver’s license or work in a field where a clean driving record is required.

Three to Five Year Probation:
Most counties in California impose a three year informal (court) probation. Monterey County is more strict, with a five year probationary period.
